Douglas Factors are used to decide the final penalty, but there is no guidance on setting the proposed penalty. This is important because it establishes the penalty ceiling. Too high of a penalty may cause the agency to lose credibility. Too low of a penalty can come back and haunt the agency, especially with regards to disparate treatment claims.
